Terms of Service

1. Acceptance of Terms

By creating an account or using PocketPrice (“Service”), you agree to these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and subscribers.

2. What PocketPrice Does

PocketPrice is a pricing guidance tool for antique and resale vendors. It analyzes item descriptions, photos, and your market profile to generate estimated price ranges based on comparable historical sales data. All output is for informational and guidance purposes only.

PocketPrice does not buy, sell, appraise, or broker items. It is not a licensed appraisal service. Estimates should not be used for insurance, legal, tax, or estate valuation purposes.

3. Pricing Estimates Disclaimer

All prices, price ranges, sweet spots, confidence scores, and recommendations provided by PocketPrice are estimates derived from automated analysis of comparable sales data and your personal market profile. By using the Service you acknowledge and agree that:

• Pricing estimates are not guarantees of actual sale price, fair market value, or item worth.
• Market conditions, local demand, item condition, buyer preferences, and other factors outside our control can affect actual sale prices.
• Final pricing decisions are entirely your responsibility. PocketPrice is a tool to inform your judgment, not replace it.
• PocketPrice is not liable for any financial loss, missed sale, buyer dispute, or other damage resulting from pricing decisions made using this Service.

4. Accounts

You must be 18 years of age or older to create an account and use the Service. By creating an account you represent that you meet this requirement.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@thepocketprice.com if you suspect unauthorized access to your account.

5. Subscriptions and Payments

• Paid subscriptions (Picker, Vendor, Pro) are billed monthly and renew automatically on your billing date.
• You may cancel your subscription at any time through your Account page. Cancellation takes effect at the end of the current billing period; you retain access until that date.
• Top-up lookup packs are one-time purchases. They do not expire and are not tied to a subscription.
• All payments are processed securely by Stripe. PocketPrice does not store your credit card number or payment card details.
• Except as required by applicable law, all payments are non-refundable. If you believe a charge was made in error, contact us at support@thepocketprice.com within 14 days.
• Free trial lookups (25 total) do not reset and are not transferable to a paid subscription lookup balance.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, state, or federal law or regulation.
• Reverse-engineer, scrape, copy, or create derivative works from the Service or its outputs.
• Use automated tools, bots, or scripts to make pricing requests.
• Share your account credentials with other individuals.
• Resell or redistribute pricing outputs as a standalone service or product.
• Attempt to circumvent lookup limits through multiple accounts or other means.

7. Intellectual Property

The PocketPrice name, logo, software, and Service design are owned by PocketPrice and its operators. Your account data, market profile, price corrections, and lookup history belong to you. You grant PocketPrice a limited license to use your corrections and feedback solely to improve the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF PRICING ESTIMATES, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PRICING ESTIMATES WILL BE ACCURATE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POCKETPRICE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS OR REVENUE, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS ($50).

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 7 days before they take effect. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction.
